Like the “grates case”, the application of NFIP regulations allowed FEMA to reverse significant funding reductions imposed initially on the S&WB’s Wastewater Treatment Plant Project Worksheets.

This reversal was possible only after the S&WB was able to substantiate greater than 50% of the facility value below ground, and in accordance with NFIP regulations the entire facility was exempt from flood insurance requirement.
